[DE] In einer persönlichen Mail wurde ich gefragt, ob diese Gruppe mit dem Persönlichkeitsrecht und mit der EU-Datenschutz-Grundverordnung vereinbar sei.

Zunächst ist dazu zu sagen, dass die Veröffentlichung von Selbstportraits durch den Fotografen selbst nicht verboten ist. Jede(r) darf sich zeigen sie(er) will, solange sie(er) damit keine Gesetze verletzt (Pornografie, Hetze, etc.) Zum eigenen Schutz sollte man allerdings darauf achten, was man von sich preisgibt.

Wenn allerdings zusätzlich andere Personen oder geschützte Werke (Gemälde, in Frankreich auch diverse Gebäude) mit abgebildet sind, muss man selbstverständlich die diesbezüglichen Gesetze beachten, die von Land zu Land unterschiedlich sind. Ich verlinke gern zu einigen informativen Seiten:

Für diese Gruppe ist das alles aber insofern irrelevant, weil sie nur eine Agglomeration von Bildern ist, die ihr sowieso in euren eigenen Accounts veröffentlicht habt. Bitte seid euch bei Selfies einfach eurer Verantwortung als Urheber und Rechteinhaber bewusst.

[EN] Dans un courrier personnel, on m'a demandé si ce groupe était compatible avec le droit de la personnalité et avec le règlement de base de l'UE sur la protection des données.

Tout d'abord, la publication d'autoportraits par le photographe lui-même n'est pas interdite. Chacun a le droit de se montrer tant qu'il ne viole aucune loi (pornographie, agitation, etc.), mais pour sa propre protection, il faut faire attention à ce qu'il révèle de lui-même.

Si, cependant, d'autres personnes ou œuvres protégées (peintures, en France aussi divers bâtiments) sont également représentées, il faut bien sûr respecter les lois en vigueur, qui varient d'un pays à l'autre. (Les liens ci-dessus mènent à des sites Web allemands.)

Pour ce groupe, cependant, tout cela n'a pas d'importance car ce n'est qu'une agglomération d'images que vous avez publiées dans vos propres comptes de toute façon. Veuillez être conscient de votre responsabilité en tant qu'auteur et détenteur des droits d'auteur lorsque vous utilisez Selfies.

[FR] In a personal mail I was asked whether this group was compatible with the right of personality and with the EU data protection basic regulation.

First of all, the publication of self-portraits by the photographer himself is not prohibited. Everyone is allowed to show himself/herself as long as he/she does not violate any laws (pornography, agitation, etc.). For his/her own protection, however, one should pay attention to what one reveals of oneself.

If, however, other persons or protected works (paintings, in France also various buildings) are also depicted, one must of course observe the relevant laws, which vary from country to country. (The links above lead to German websites.)

For this group, however, all this is irrelevant because it is only an agglomeration of pictures that you have published in your own accounts anyway. Please be aware of your responsibility as author and copyright holder when using Selfies.

[EN] I ask for your understanding that with 24 pictures I did not ask every single one for permission to use the image sections in the banner. Although one could regard such an ipernity-internal form of use as permissible ("reproduction and adaptation of content freely available to the public in the sense of presentation and promotion of the service") according to the terms of use paragraph 5.10, I would like to expressly point out that I will remove the portrait in question from the banner immediately and replace it with another if there is any objection.

[FR]Je vous demande de comprendre qu'avec 24 photos, je n'ai pas demandé à chacune d'elles la permission d'utiliser les sections d'images dans la bannière. Bien que l'on puisse considérer qu'une telle forme d'utilisation interne à l'Internet est autorisée ("reproduction et adaptation de contenus librement accessibles au public dans le sens de la présentation et de la promotion du service") conformément aux conditions d'utilisation du paragraphe 5.10, je tiens à souligner expressément que je retirerai immédiatement le portrait en question de la bannière et le remplacerai par un autre si je m'y oppose.

[DE] Ich bitte um Verständnis dafür, dass ich bei 24 Bildern nicht Jede(n) einzeln um Erlaubnis für die Verwendung der Bildausschnitte im Banner gefragt habe. Obwohl man gemäß Nutzungsbedingungen Abs. 5.10 eine solche ipernity-interne Form der Verwendung als zulässig ansehen könnte ("Reproduktion und Adaption eines für die Öffentlichkeit frei verfügbaren Inhalts im Sinne der Präsentation und Förderung des Dienstes"), möchte ich ausdrücklich darauf hinweisen, dass ich bei Widerspruch das betreffende Portrait natürlich sofort aus dem Banner entferne und durch ein anderes ersetze.

[EN] This group was founded two years ago by René Boes, just before he left with Burn Out. Since then it has been living in a quiet corner.

I think his idea that we Iperians can show us here from a personal side is very timely. We are not only anonymous photographers behind the camera, but real people with personality, hobbies and quirks.

Anna Schramm and I would therefore like to give this group a new chance. Please don't publish artworks of yours here, but your Selfies.

[FR] Ce groupe a été fondé il y a deux ans par René Boes, juste avant son départ avec Burn Out. Depuis, ils vivent dans un coin tranquille.

Je pense que son idée que nous, les Ipériens, pouvons nous montrer ici d'un point de vue personnel est très opportune. Nous ne sommes pas seulement des photographes anonymes derrière l'appareil photo, mais de vraies personnes avec de la personnalité, des passe-temps et des caprices.

Anna Schramm et moi-même voudrions donc donner une nouvelle chance à ce groupe. S'il vous plaît, ne publiez pas vos oeuvres d'art ici, mais vos Selfies.

[DE] Diese Gruppe wurde vor zwei Jahren von René Boes gegründet, kurz bevor er sich mit Burn Out verabschiedete. Seitdem fristete sie in einer stillen Ecke ihr Dasein.

Ich finde seine Idee, dass wir Iperianer uns hier von einer persönlichen Seite zeigen können, sehr zeitgerecht. Wir sind ja nicht nur anonyme Fotografen hinter der Kamera, sondern echte Menschen mit Persönlichkeit, Hobbies und Schrullen.

Anna Schramm und ich möchten dieser Gruppe deshalb eine neue Chance geben. Bitte veröffentlicht hier keine Kunstwerke von euch, sondern eure Selfies.
